TERMS AND CONDITIONS FOR THE SAFARICOM ELIMU PEPE SERVICE
The following terms and conditions apply to the Safaricom Elimu Pepe Service (“the Service”) and by activating in this Service, you will be deemed to have read, understood and accepted the same: -
1. The Service
(a) This Service is offered in partnership with LoHo Learning Limited and it seeks to enable Safaricom subscribers’ to purchase mobile data and the LoHo Learning educational content, known as “Elimu Pepe” at an affordable cost.
(b) Elimu Pepe is an educational mobile application developed by LoHo Learning Limited, designed to support learners following Kenya's Competency Based Education (CBE). The Platform, accessible on App and Web provides:
i. Access to CBE-aligned learning content across multiple subjects and grade levels.
ii. Interactive quizzes and learning exercises (Elimu Quest).
iii. Gamification features including leaderboards, badges, and achievement rewards.
iv. Subscription-based access with optional data bundle add-ons via Safaricom.
(c) The Platform operates as a WebView application and PlayStore App, displaying and an internet connection is required to access most features.
2. Eligibility
(a) This Service is open to all Safaricom PrePay, Hybrid and PostPay subscribers. Where the Elimu Pepe Service is being accessed by users under the age of 18, they must have the consent of a parent or legal guardian.
(b) Accounts for children under 18 must be created and managed by a parent or guardian.
(c) By registering an account for a child, you understand that you represent the child's parent or legal guardian and agree to these Terms on their behalf.
3. Launch of Service
This Service was launched at 0000 hrs on 13th February 2026 and these Terms and Conditions were amended on 12th May 2026.
4. How to participate in the Service
To participate in the Service, we have the below options:
(a) .
a) If you have your own device and only require content + a data bundle
i. Dial *544*14# from your Safaricom mobile line to purchase a subscription.
ii. Select the content category: “eBooks +Audiobooks”, or “Quizzes & Revision Papers” then “Elimu Pepe” if you wish to subscribe to Elimu Pepe service.
iii. You will see the options listed in the table below. Please proceed to select your preferred one:

vii. You will then receive an SMS notification with a link to Elimu Pepe content that will allow you access the content. For example:
“You have successfully purchased Elimu pepe content pass @ Ksh.10 for 24hrs. Click https://elimupepe.loholearning.co.ke to access. To unsubscribe, Dial *544*73#.”

5. Responsibility of the account
(a) You are responsible for maintaining the confidentiality of your account credentials.
(b) You are responsible for all activity that occurs under your account.
(c) You must notify LoHo immediately at support@loholearning.co.ke if you suspect unauthorised access to your account or if you have any challenges within the platform or accessing the content.
(d) Safaricom will be responsible for Billing and Data Bundle provision and in the event you experience any challenges, please contact Safaricom on line 100, 200 or elimu@safaricom.co.ke

(f) One account may be used to manage a maximum of 4 learner profiles within the same household.
6. Billings and payments
(a) All payments are processed by Safaricom via Direct Carrier Billing. Charges will be deducted from your Safaricom mobile account balance or airtime.
(b) Auto-renewing subscriptions will be charged automatically at the end of each billing period unless cancelled before the renewal date.
(c) LoHo does not store your Safaricom account credentials or payment card information.
(d) Subscription prices are listed in Kenyan Shillings (KES) and include applicable taxes.
7. Cancellations and Refunds
(a) You may cancel an auto-renewing subscription at any time. Cancellation takes effect at the end of the current billing period.
(b) One-off (non-recurring) subscriptions are not automatically renewed and require no cancellation.
(c) Refunds are handled in accordance with Safaricom's billing policies. LoHo does not independently issue refunds for carrier-billed transactions. For billing disputes, please contact Safaricom customer care or reach us at support@loholearning.co.ke.
(a) Access to premium content is contingent on an active subscription. If your subscription lapses, access to paid features will be suspended until renewed.
(b) Data bundle benefits (150MB/day or 5GB/month) are provided by Safaricom and are subject to Safaricom's own data terms and fair use policies.
9. Acceptable Use
You agree to use the Elimu Pepe platform on App/Web only for lawful, educational purposes. You must NOT:
(a) Use the platform to distribute spam, malware, or harmful content.
(b) Attempt to reverse-engineer, decompile, or extract the source code of the platform.
(c) Share your account credentials with individuals outside your household.
(d) Use automated tools, bots, or scrapers to access the Platform’s content.
(e) Impersonate another user, learner, or member of the Safaricom or LoHo team.
(f) Upload or transmit any content that is offensive, abusive, defamatory, or unlawful.
(g) Attempt to circumvent subscription verification or billing systems
Safaricom and LoHo jointly and severally reserve the right to suspend or terminate accounts that violate these rules without prior notice.
10. Gamification and competitions
Elimu Pepe includes competitive features such as the Elimu Quest leaderboard, badges, and point systems. By participating:
(a) You agree that leaderboard rankings and scores are calculated by our systems and are final.
(b) Rewards or prizes (if any) are subject to separate terms announced at the time of each competition.
(c) We reserve the right to modify, suspend, or end any gamification feature at any time.
(d) Cheating, exploiting bugs, or using unauthorised tools to gain an advantage is prohibited and may result in account suspension
11. Disclaimer of Warranties
The Elimu Pepe Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. LoHo does not warrant that:
(a) The Platform will be uninterrupted, error-free, or free of viruses.
(b) The educational content will meet any specific curriculum or examination requirements.
(c) Results from using the Elimu Pepe Platform will guarantee any academic outcome.
To the fullest extent permitted by Kenyan law, LoHo disclaims all implied warranties, including fitness for a particular purpose and merchantability.
12. Limitation of Liability
(a) To the maximum extent permitted by applicable law, LoHo shall not be liable for:
i. Any indirect, incidental, special, or consequential damages arising from your use of the Platform (App/Web).
ii. Loss of data, revenue, or educational opportunity.
iii. Service interruptions caused by third-party providers (including Safaricom network outages).
(b) Safaricom and LoHo’s total liability to you for any claims arising out of or related to these Terms shall not exceed the total amount you have paid for the Service in the 3 months preceding the claim.
13. Third Party Services
(a) The Platform, both Web and App integrate with or links to third-party services including:
i. Safaricom PLC for subscription and carrier billing.
ii. Cloud infrastructure providers for hosting and data storage.
(b) Safaricom and LoHo are not responsible for the practices, content, or availability of any third-party services. Use of third-party services is governed by their respective terms and privacy policies.
14. Termination
(a) You may terminate by unsubscribing from the platform by dialling *544*73# and deleting/ uninstalling the App and contact LoHo to close your account.
(b) Safaricom and/or LoHo may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if required by law.
(c) Upon termination, your right to use the App ceases. Provisions of these Terms that by their nature should survive termination, including limitation of liability, and governing law, shall remain in effect.
15. Governing Law and Dispute Resolution
(a) These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.
(b) In the event of a dispute arising out of or in connection with these Terms and Conditions, then you agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Kenya.

17. Other terms of the Service
(a) You can only stream the Elimu Pepe content on devices that purchase the subscription or numbers that are beneficiaries to “Buy-For-Other” proposals.
(b) You can only auto-renew your bundles using airtime.
(c) To unsubscribe from the Service, simply dial *544*73# or *544*14#.
(d) You can check your subscription by dialling *544*44#.
(e) Upon expiry of validity period, should you wish to continue to enjoy the LoHo Learning educational content, you will be required to purchase a bundle by dialling *544*14# and selecting Elimu Pepe, or through the link: https://elimupepe.loholearning.co.ke
(f) We will send you periodic notifications informing you of the balance on your bonus to enable you purchase resources.
(g) You can access LoHo Learning educational content resources at any time.
18. Privacy
(a) Definition
“Personal Information” means personal identifiable information as prescribed in the Data Protection Act which includes but is not limited;

LoHo will collect and process your personal information based on consent/ contract performance which is one of the lawful basis provided for under the Data Protection Law.
(b) Privacy
We are committed to respecting and protecting the privacy of the information we collect from you. Our privacy statement, as updated from time to time, explains how we treat your personal information, who we share your information with, and measures taken protect your privacy when you use our Service. (c) Minors
When registering a minor as a subscriber, a person with parental authority may open and maintain a mobile number in their name for and on behalf of the minor. For purposes of this agreement, a person with parental authority shall include the birth parents of a minor, or legal guardian
19. General Terms of usage
(a) You cannot transfer (Sambaza) Elimu Pepe educational content resources to other subscribers.
(b) Upon purchase, subscribers will earn Bonga Points as indicated in the published terms and conditions of the Safaricom Loyalty Program.
(c) Safaricom LoHo Learning educational content resources are not for re-sale. You therefore will not resell the Bundles purchased from Safaricom without its consent. Safaricom reserves the right to withdraw this Service from you if you breach these terms.
20. Extension of Terms
(a) Save as modified above, these Terms and Conditions are supplemental to and subject to the published Safaricom PrePay and PostPay Service Terms and Conditions and other Services that you may be using.
(b) Safaricom reserves the right to amend or vary these terms and conditions or to withdraw the Service at any time. In any of these events, notice will be given via media advertisements (including at Safaricom’s discretion on the Safaricom website www.safaricom.co.ke) and will be effective immediately or as at the date referred in such notifications.
